The following
conditions will constitute the agreement between the parties:
1. Lots described will be
advertised for sale on Pugilistica.com on behalf of
the seller of the above listed items.
2. Seller guarantees full and
clear title to all offered items to prospective buyers.
3. Dave’s Classic Collectibles will be responsible for advertising items on the website Pugilistica.com via seller provided photos, descriptions or any other information of relevance concerning the offered items.
4. “Asking” or “For Sale” prices will be agreed upon by the seller and Dave’s Classic Collectibles. Initial offered sale prices may be changed with the approval of the seller.
5. Owner of the item provides accurate scans/photos, pertinent information about the item and keeps items in possession until sale.
6. Dave’s Classic Collectibles provides the sellers direct contact info to prospective buyers to negotiate a sale between the interested collector and the items owner.
7. Actual sales, payment and shipping terms, etc., are negotiated between the owner of the item and the prospective buyer only. Dave’s Classic Collectibles and Pugilistica.com will only be acting as an ad venue and referral agent between the two parties.
8. Dave’s Classic Collectibles and Pugilistica.com shall not be held liable for any disputes arising between the subjects of a transaction in the Marketplace area.
9. The following referral fees will be charged to the seller by Dave’s Classic Collectibles based on the final sell price of each item:
9.9% of
the first $10,000
4.9% of any amount above $10,000
10. The Seller must notify Dave’s Classic Collectibles / Pugilistica.com within 2 days after an advertised item has been sold and the exact amount it was sold for so applicable referral fees may be charged and billed to The Seller.
11. The Seller will notify Dave’s Classic Collectibles / Pugilistica.com if an item is no longer available for sale for any reason whatsoever so it may be removed from the website or marked as “Sold”.
12. Referral fees from the sale shall be sent to Dave's Classic Collectibles within 14 days of the sale date.
13. Referral fees can be
accepted by Dave’s Classic Collectibles in the form of a Credit/Debit Card

14. At any time the seller may request a change (upon approval) from the “Premium Marketplace” format to a “Consignment” format from Pugilistica.com (ex. Auction Consignment, General For Sale Consignment), at which time the applicable consignment rates and terms for that format will apply.
15. Items will be dated when posted on the site and the listing will expire after a period of 1 year if no sale is made, unless otherwise requested by the owner of the item.
16. The Seller is to provide valid contact information below which Dave’s Classic Collectibles will have permission to pass on to interested parties or prospective buyers. Please print.
